Removed Child Class
First Nations individuals who were under the age of majority were removed from their homes by Child Welfare Authorities and placed into care that was funded by Indigenous Services Canada (ISC) between April 1, 1991, and March 31, 2022, and were resident on a reserve, or were living in the Yukon between April 1, 1991, and March 31, 2022.
Removed Child Family Class
Parents or grandparents who were the primary caregiver of a First Nations individual who was were under the age of majority and was taken into out-of-home placement by the Child Welfare Authorities and placed into care that was funded by Indigenous Services Canada (ISC) between April 1, 1991, and March 31, 2022, and were resident on a reserve, or were living in the Yukon between April 1, 1991, and March 31, 2022.
Jordan’s Principle Class
First Nations Individuals who were underage and who during the period between December 12, 2007, and November 2, 2017:
- Were denied essential services and supports and the Government of Canada failed to comply and uphold Jordan’s principle, and/or
- Experienced delays of essentials services because of lack of funding or jurisdictional dispute between the federal and provincial/territorial governments.
Jordan’s Principle Family Class
Individuals who were the primary caregiver of a First Nation Individual who was underage and who during the period between December 12, 2007, and November 2, 2017:
- Was denied essential services and supports because the Government of Canada failed to comply and uphold Jordan’s principle, and/or
- Experienced delays of essentials services because of lack of funding or jurisdictional dispute between the federal and provincial/territorial governments.
Trout Class
First Nations individuals were underage and whom during the period between April 1, 1991 and December 11, 2007 did not receive essential service from Canada either because of denial or service gap because of:
- Funding
- Lack of jurisdiction
- Dispute of jurisdiction between governments
The caregiving parents or the caregiving grandparents of children who were removed from their homes or denied access to an essential service may also be able to receive compensation.
Trout Family Class
Individuals who were underage and whom during the period between April 1, 1991 and December 11, 2007 did not receive essential service from Canada either because of denial or service gap because of:
- Funding
- Lack of jurisdiction
- Dispute of jurisdiction between governments
